General Sale Terms & Conditions

Sale Information: Information regarding the sale will be released online on our website and various listing sites; please DO NOT call, email or contact our team regarding information, including pricing and availability before and during the sale.

To Purchase Items: Unless otherwise noted, items can only be purchased at the site of the sale. You MUST be in attendance to purchase the item(s); please DO NOT call about availability, pricing of items or purchase during the sale. Nicholas Luke Estate Sales reserves the right to add or remove items, cancel, suspend, extend, or reschedule an individual item, live sale, and or auction or to make changes to the start and closing times or removal times. Items not sold during the sale are removed from the sale after the sale closes. No items are available for purchase after the completion of the sale.

Items for Bid: All items over originally priced over $150 per item are available to purchase as marked or available for bid, at minimum bid equal or greater than sixty percent (60%) of the original asking price. All other items priced $149.99 and under are not for sale by bid, unless noted otherwise. Shipping & Delivery: We cannot ship or deliver items. Please bring your own help to load large or heavy items. Movers are not available.

Pick Up and Load Out: Items may be removed upon purchase, picked up during the hours of the sale, or by scheduled appointment; any items remaining after the specified load-out dates (final date of the sale) will be considered forfeited, unless alternate pickup or shipping arrangements are made. It will be the buyer's responsibility to dismantle any and disconnect all equipment. Please bring your own tools, labor, packing materials and moving equipment.

Payment: We accept cash and most all major credit/debit cards, Apple Pay, PayPal, and Venmo, which shall be subject to a 4% processing fee per transaction; applicable sales tax may apply. We do not accept personal checks. For vehicles, trailers or sales over $1,000: payment will be accepted in the form of cash, certified check and/or wire transfer (credit/debit, Apple Pay, PayPal, and Venmo will not be accepted, applicable fees may apply. Payment must be made prior to picking any items up.

We are not responsible for any accidents, whether on the exterior property or inside the house.

Markers are allowed. If you leave a marker, please do NOT leave the immediate area/premises. If you leave, your place in line is no longer reserved and you will be required to move your marker.

Warranty & Conditions of Items Sold "As-Is": All items are sold 'AS IS, WHERE IS, with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. Items part of a court-ordered sale are subject to court approval. No refunds, exchanges or returns.

NEITHER PARTY MAKES ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF ACCURACY, COMPLETENESS, PERFORMANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, COMMERCIAL UTILITY, SCOPE, OR TITLE WITH RESPECT THERETO.

Sale Period: The auction will open promptly at 8:00AM, or as advertised on www.lukeestatesales.com, and will conclude at 11:59PM on the final advertised sale date (for example: on a June 1st through June 4th sale, bidding shall open at 8:00AM on June 1st and close at 11:59PM on June 4th). No further bids will be accepted past the closing date and time.

Notification: The successful winner of the auction will be notified within 48-hours of the conclusion of the Sale Period. We utilize scheduled load-out by appointment. We will be sending out an email to all winning bidders with a link to sign up for an appointment after the auction is over.

Technical Issues: Neither party or the company providing access, software of technical support shall be held responsible for a missed bid or failure to submit a bid online. Email notification will be sent to registered bidders with updated information as deemed necessary by Nicholas Luke Estate Sales.

Nicholas Luke Estate Sales reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices. Nicholas Luke Estate Sales reserves the right to cancel, suspend, extend, or reschedule an individual item and or auction event or to make changes to the auction closing times or inspection or removal times.
